Held without charge, a Miami inmate’s unborn child asks court for release in odd case

An attorney is arguing that the fetus’s incarceration is a violation of his rights.


MIAMI — For eight months, someone has been held at Turner Guilford Knight Correctional Center with no charge.

Natalia Harrell, an inmate at the center, is carrying the person behind the case: an unborn child. And it could even set a precedent amid a legal system navigating complex arguments in a post-Roe world.

On Thursday, attorney William M. Norris filed an emergency writ of habeas corpus, which allows the court to determine whether someone’s imprisonment is lawful. He argued that the fetus’s incarceration is a violation of his rights guaranteed by the U.S. and Florida constitutions.

“UNBORN CHILD has not been charged with any crime by the State,” the writ of habeas corpus said. “Further, the State has placed the UNBORN CHILD in such inherently dangerous environment by placing the UNBORN CHILD in close proximity to violent criminal offenders.”

The 24-page document claims that the “draconian confinement” is harming Harrell’s unborn child. It says the fetus isn’t receiving adequate prenatal care, including vitamins and visits to specialists, and also has been the victim of negligence — at one point being trapped in a corrections transport van without air conditioning while temperatures exceeded 100 degrees.

The unborn child, the writ argues, should be released so they can get necessary care and treatment, be free from “unlawful and illegal detention” and avoid entering the world in a dangerous environment like a prison cell.
Harrell, 24, was arrested and charged with second degree murder — a felony punishable by life in prison — while 6 weeks pregnant on July 26, 2022. She was involved in fatal quarrel that was caught on tape while inside an Uber near Southeast First Avenue and First Street in Brickell.
As she and Gladys Yvette Borcela argued, Harrell leaped from the third row of seats to the second row. Harrell’s lawyers say that she feared Borcela wanted to harm her and her unborn child, and that’s why she pulled out a gun from her purse and fired a single round.

As a pastor, I can tell you that all life is sacred' all life has inalienable rights.

Only God knows what terrible torments that unborn person is going through. Immediate release is the least that can be done: I also see a suit for unlawful detention and false arrest.

A great public service you are doing, Pastor, by bringing this injustice to light. Babies cannot be imprisoned if they have not been charged with a crime. It's time liberals, including Biden, wake up to this.

What that child hears, and mother's voice is by far the loudest thing in utero, remains a powerful influence throughout its life. What conversations is she having? Those words will be ingrained and a natural comfort towards which one would gravitate, particularly during times of stress, whether one knew what the words meant or not – although after one learned to talk the meanings would be known, so it's important that mother is singing hymns and reading Bible verses out loud during at this stage: very unlikely when incarcerated: Ezekiel 18 was the perfect text.

That being said, I am a bit worried male criminals are going to claim being pregnant females, as seems to be the latest trend, to get out of prison.

A mother and child are partners in crime. If the mother commits a felony, it is a decent persons responsibility to to turn that person in or at least ensure a Pastor knows about the evil deeds in transparent detail.
I give a lot of latitude to the feeble and undeveloped as I know many of their faults and sins are brought on to them as a punishment by God to the parents. But even a man like me whose care and patience knows no bounds has limitations.

Brother Hutchins has put his finger on the issue. That unborn child is a vile and unrepentant sinner. Until he accepts Jesus as his personal savior, he deserves whatever punishment he gets.

I've heard there are more incentives to accept Christ in prison that abroad in a wicked world. This could be the silver lining here and a real opportunity for baby to get ahead once released. I suppose if mother was in for life, it would get out at 18? Not sure on that but WILL say that 21 is a much more sensible age of majority than 18. It's why 21st birthday cards have a key to the door.
