What should be the penalty in Strauss-Kahn rape case? -

Assuming it is true that the head of the IMF raped this chamber maid, I wonder what the penalty should be. According to Deuteronomy 22:23-24, she should be put to death because it was in a city and she did not cry out. However, she was not a virgin, so perhaps just flogging or imprisonment is in order.
Do you think perhaps the Landover Legal Department might wish to prepare an amicus curiae brief outlining God's instructions so that perhaps, for once, the courts will impose the proper sanction on this woman? It seems the courts are letting women who get themselves raped off very lightly these days, particularly in the Obama Administration.
