        The city adds sexual orientation to the listof classes that are protected from discrimination

        SPRINGFIELD — The City Council gave quick and unanimous approval Monday to an ordinance that protects gays and lesbians against discrimination.

        The ordinance amends Springfield’s charter by adding “sexual orientation” to a list of classes for which an individual cannot be treated with prejudice. Under the charter, individuals also may not be discriminated against based on their “race, color, religion, sex, age, marital status, disability or national origin.”

        The amendment was essentially a “housekeeping matter,” said Joe Leahy, Springfield’s city attorney, as the clause was mistakenly left out of the discrimination section when Springfield redrafted its charter in 2001.

        The ordinance won’t bring about any practical change as discrimination against gays and lesbians is already prohibited at the state level, Leahy noted. Under the Oregon Equality Act of 2007, discrimination against homosexuals is illegal in areas of employment, housing, public accommodations, public education, foster parenting and jury service.

        The addition marks the first time Springfield has explicitly taken a position against such discrimination since the city drew national attention in 1992 for becoming the first in America to add anti-gay language to its code.

        That year, 55 percent of Springfield voters approved a ballot measure that barred the city from taking any step that specifically protected homosexuals from discrimination, and stated that the city could not “promote, encourage or facilitate” homosexuality, pedophilia, sadism or masochism.

        “The measure has put Springfield on the map nationally and internationally as the city that voted to institutionalize discrimination against homosexuals,” a Register-Guard editorial asserted on June 19, 1992.

        The ballot measure was championed by the now-defunct Oregon Citizens Alliance, an organization led by activist Lon Mabon that fought against gay rights throughout the state in the 1990s.

        The alliance was unsuccessful in its 1992 campaign to place anti-gay language in the state constitution, but voters in 25 other Oregon cities and counties approved the addition of such terminology to their charters by May 1994. Junction City, Creswell, Cottage Grove, Oakridge and Veneta were the other Lane County cities to do so.

        All the charter changes were later invalidated by the Oregon Legislature and by the courts — though in Springfield’s case the anti-gay language remained in the charter, unenforced, until the 2001 redraft.

        Springfield Mayor Christine Lundberg, who became a city councilor in 1999, said after the meeting that the charter addition was an important step toward ridding the city of some of the “stigma” it had earned through the 1992 vote.

        “Over the last year or so, we’ve taken on diversity in a meaningful way, and this (addition) just fits with that,” she said.

        Lundberg said the memory of the 1992 vote had lived on for many years, particularly in the minds of people outside the community.

        “We’ve carried it for a while,” she said. “But now, as a council, we’ve put our tolerance in writing.”

          It baffles me that a town like Springfield lays down its weapons and lets Satan just march right in.

          Here in Freehold, we have on our doorstep arguably some of the most sinful places on the planet--homer marriage, homer bars, harlots, liberal politics and you name it. But, none of it darkens the door of Freehold.

            Council: Dismantle Occupy Eugene site

            Occupy Eugene’s 45-day stay in Washington-Jefferson Park is about to end.

            But exactly when the encampment will be cleared — and what tactics the city will use to evict campers — remained unclear tonight, hours after the Eugene City Council instructed police to dismantle Occupy Eugene’s base as soon as practicable.

            During an emergency meeting called by Mayor Kitty Piercy, councilors voted 5-2 to end the protest group’s permission to stay overnight in the park. Councilors Betty Taylor and George Brown cast the dissenting votes. Councilor Alan Zelenka was out of town and unable to attend the meeting, but Piercy said he had indicated to her that he supported ending the encampment.

            Piercy said she requested the meeting after learning that a man had suffered potentially life-threatening injuries in a fight at the campsite late Monday night.

            Police said the incident was one of five altercations they responded to in the encampment during a four-hour period.

            The reported surge in violence “has caused me to see the wisdom in moving sooner,” Piercy said. Last week, councilors voted 5-3 in favor of allowing Occupy Eugene’s collection of homeless people and political protesters to stay in the park until Jan. 11.

            Police Chief Pete Kerns told councilors that a “thoughtful and deliberate approach” will be used to close the camp. He declined to reveal details of the plan, which he said has been developed during the past few weeks and was still being “refined” on Tuesday afternoon.

            “I’d like there to be no arrests, but I understand there may be acts of civil disobedience,” Kerns said following the council meeting. He mentioned that most Occupy camps in cities throughout the country have closed peacefully this fall.

            The Eugene protest, inspired by the Occupy Wall Street movement, started in mid-October in the downtown Park Blocks. After a couple of moves it settled in Washington-Jefferson Park on Nov. 5 and expanded from being a political protest to being a magnet for homeless people across the metro area.

            Occupy Eugene member Alley Valkyrie said she expects police will encounter some resistance whenever they begin evicting people from the park encampment.

                    I still don't get these children whining about their "First Amendment right to free speech".

                    Nobody is preventing them from speaking out against or in favor of whatever flavor of Satanic depravity they like. They can publish pamphlets, write letters to the editor, stand on street corners with signs, or fling their feces at Tila Tequila (the way the Juggalos do).

                    Setting up a tent city is not an exercise in free speech! If it were, then every piece of public property in the country would be transformed into homeless camps!

                    But I guess that's what these 'people' want.


                    I wonder if the public response would have been different if the "occupiers" were people who'd lost their homes to foreclosure, instead of middle-class kids with nothing better to do than annoy others and whine about perceived 'injustice'.

                      Couple charged in son’s death

                      The two face manslaughter counts accusing them of failing to get a teen medical help for a treatable illness

                      CRESWELL (a suburb of Eugene)— A mother and her husband face manslaughter charges in the death of the woman’s teenage son — a death that authorities say could have been prevented had the couple disregarded their religious beliefs and taken him to see a doctor after he fell ill in December.

                      Lane County sheriff’s deputies arrested Brandi Shaunai Bellew and Russel Lewis Bellew of Creswell on Friday following a seven-week investigation that began with the death of 16-year-old Austin Sprout on Dec. 20.

                      Their case could test a new state law that eliminates the legal defense of “faith healing” for parents who refuse medical care for a sick child. The Bellews belong to the General Assembly and the Church of the First Born, which has been linked to a number of deaths related to healing by prayer.

                      Sprout, a Creswell High School junior who was Brandi Bellew’s biological son, had been ill for more than a week before he died, sheriff’s Lt. Spence Slater said.

                      Because of their religious beliefs, the Bellews allegedly did not take the teen to a doctor after he became sick, Slater said.

                      Investigators on Friday declined to reveal the teen’s cause of death, but Slater said medical professionals have indicated that Sprout’s condition was “highly treatable.”

                      A Lane County grand jury earlier this week issued an indictment charging the Bellews with second-degree manslaughter, a charge that carries a mandatory minimum prison term of 6 years, 3 months upon conviction, Slater said.

                      Brandi Bellew, 36, was arrested at her Creswell home, while deputies took her 39-year-old husband into custody at his workplace, Slater said.

                      Under state law, the charge of second-degree manslaughter is defined in part as causing a dependent person’s death by neglect or maltreatment, including failure to provide adequate medical care.

                      “Our opinion is that if (the Bellews) would have taken (Sprout) to a doctor to seek medical attention, he would have survived,” Slater said.

                      Sheriff’s detectives have investigated two other relatively recent deaths involving Sprout’s family, Slater said.

                      They include the 2007 death of Sprout’s biological father, Brian Sprout. According to an obituary submitted by the family, Brian Sprout died at age 35 of sepsis related to a complication from a leg injury. Investigators found that Brian Sprout had not sought medical treatment before he died, but that didn’t constitute a crime because he was an adult, Slater said.

                      The second case investigated by the sheriff’s office arose in October 2010, when Austin Sprout’s grandmother, Mary Sprout of Creswell, died of what were initially described as unknown causes. Her death certificate states that investigators later learned that she died at age 54 of acute myeloid leukemia, a relatively common cancer that is curable, according to the National Institutes of Health.

                      State law requires police and medical examiners to investigate deaths that occur in situations where physicians are not present.

                      Sheriff’s officials have heard from many people in the Creswell community who have been interested in finding out whether anyone would be held responsible for Austin Sprout’s death, Slater said.

                      “We’ve taken a lot of heat on this case,” he said. “The community had a lot of questions, and wanted to know what we were doing.”

                      On Friday, state Department of Human Services officials accompanied sheriff’s deputies to the Bellews’ home on Sunday Drive. Agency spokesman Gene Evans said DHS employees conducted a “safety assessment” of other children in the home and arranged for them to be cared for by other relatives.

                      Austin Sprout’s obituary lists six siblings. Evans said he knew that there were several children in the home on Friday, but he did not have an exact number nor their ages.

                      The welfare of the other children concerned Michelle Kessel, a family member and former Lane County resident who now lives in Washington state. Kessel said she grew up in the General Assembly and the Church of the First Born with Brandi Bellew and Brian Sprout, who was Kessel’s cousin.

                      Kessel said she remains saddened by Austin Sprout’s death, but does not believe that Brandi Bellew should be held responsible.

                      “She’s a good woman and a good mother, and she would never, ever do anything on purpose to hurt her children,” Kessel said. “I don’t feel like (the Bellews) deserve to be in jail. I don’t think it’s a fair and just law, because people in this country have their freedom of religion.”

                      Last year, Gov. John Kitzhaber signed a bill into law that removes Oregon from the ranks of the dwindling number of states where criminal statutes provide special legal protection for parents who treat their seriously ill children with faith healing instead of providing medical care.

                      The General Assembly and the Church of the First Born has a history of deaths related to healing by prayer, according to the Rick Ross Institute, an Internet archive of information about cults, controversial groups and movements.

                      In October, an Oregon City couple went to prison after being found guilty of second-degree manslaughter in their infant son’s death in 2009. Dale and Shannon Hickman attended the Followers of Christ church, which has a long history of children dying from treatable medical conditions. However, the Hickmans did not rely on a religious defense during their trial and were prosecuted under laws in effect when the baby died.

                      The Hickmans are among several parents affiliated with the Oregon City Followers of Christ church charged and sentenced for manslaughter and other crimes in recent years for the death or medical mistreatment of their children.

                        Risky ‘choking game’ crops up at South Eugene

                        Parents of high school students are warned that the practice of self-asphyxiation can bring deadly results

                        Pockets of students at South Eugene High School are experimenting with an old and dangerous game: choking themselves for the brief disorienting thrill that some say going unconscious provides.

                        Principal Randy Bernstein informed parents in a weekly electronic newsletter that goes out to about 1,000 subscribers on Monday that the trend had cropped up at the school.

                        Known most commonly as the choking game, it involves cutting off breathing until someone passes out. In some versions, kids do it to each other. In others, they choke themselves.

                        Kids — more commonly middle school students — around the world have experimented with self-asphyxiation for years, with sometimes deadly results.

                        The federal Centers for Disease Control and Prevention estimated that from 1995 to 2007, 82 children from ages 6 to 19 died while playing the game alone or with others. Nonprofit groups that have sprung up to spread the word about the dangers say the numbers probably are much higher because the deaths are often reported as suicides.

                        Death isn’t the only result. Some youth have lapsed into permanent comas after cutting off the oxygen to their brains.

                        Three South Eugene freshmen, who agreed to talk about the local trend on the condition that their names not be used, said that all of them had seen students try it in recent weeks and that two of them had done it themselves.

                        The students who tried it — both 15-year-old boys — said they had done it more than once, despite having heard from friends that some kids have died in the attempt to get high by strangling themselves.

                        One, a lanky dark-haired young man with an easy smile, said that he fell over backwards and bit his tongue when he did it.

                        “My tongue was bleeding, and it hurt a lot,” he said.

                        The second time he tried it, he said he felt the disorienting effects.

                        The other student, a compactly built blond boy, said he asked a friend to stand behind him and catch him when he fell.

                        He came to lying on top of his friend.

                        “I was a dead weight. I crushed him,” he said.

                        The third time he tried it, he was so disoriented after regaining consciousness that he didn’t know what day or hour it was, a scary feeling that convinced him he shouldn’t try it again.

                        The third student, a 15-year-old girl, said she had not choked herself but that pretty much all of her friends had done it.

                        “They get really, really light-headed,” she said.

                        The girl said she didn’t want to do it because of her goal of being a scientist or a medical doctor.

                        “I like getting good grades,” she said. She speculated that cutting off oxygen to the brain even for a brief period would kill thousands of brain cells.

                        Both boys said they suspected their parents knew they were experimenting with it. The lanky one said his mother had confronted him about it recently, perhaps because of the video a friend shot showing him participating.

                        The blond student said his parents had a kind of intuition about things and that after he finished a phone conversation with a friend about it, his mom said: “So, are you talking about the passing out game?”

                        A study at a Texas university published last month found that 16 percent of students had tried self-asphyxiation, and that 90 percent of them had learned about it from friends. Glen Kercher of the Crime Victims’ Institute at Sam Houston State University conducted the research.

                        Information on the Internet, much of it from YouTube videos, makes it easy for kids to share information. Research published in the academic journal Clinical Pediatrics in 2010 found 65 YouTube videos that showed the self-asphyxiation.

                        In 55 percent of the videos, the participants choked to the point that they experienced seizures, jerking convulsively on the ground. The videos were collectively viewed almost 200,000 times, researchers said.

                        In Oregon, a 2009 statewide survey of 11th-graders conducted by the state’s Public Health Division found that 34 percent of them had heard of someone participating in self-asphyxiation and that 7 percent had tried it themselves.

                        Oregon researchers also asked the question of eighth-graders in the annual health surveys because the activity seems to be more common among young teens than older ones, according to Robert Nystrom, adolescent health section manager with the Oregon Public Health Division.

                        “It peaks in the younger years and then tapers off,” Nystrom said. In 2009, almost 24 percent of eighth-graders said they had heard of someone participating and 6 percent said they had tried it.

                        The state is still analyzing information from its 2011 surveys, which included questions about whether students are doing this alone or in groups, Nystrom said.

                        Students who do it alone may be at a greater risk, Nystrom said. If they pass out and the rope or belt they are using to choke themselves doesn’t loosen, they suffocate and die.

                        Bernstein isn’t sure how widespread the activity is at South. In a quick check with students in the cafeteria on Tuesday, he found three or four tables of students who had never heard of it, one table of students who had just heard about it from a teacher warning them of the risks, and another table where everyone knew about it.

                        Bernstein wants parents and teachers talking about the dangers with students, while recognizing that such conversations might also serve to entice some kids.

                        “We are trying to be proactive,” he said. “When we hear these things, we want to make sure our kids stay healthy and safe and make the right decisions.”

                        The risk of death was not enough to deter the two South freshmen.

                        Bernstein, who sat in on The Register-Guard interview with the students, didn’t lecture them as they shared their experiences, but he did tell them that he would be calling their parents.

                        “We like you guys alive and healthy,” he told them. “I’ve been in this business a long time and seen too many kids die doing stupid things.”

                            Kotek Set To Make History As Nation's First Openly Lesbian House Speaker

                            SALEM, Ore. – Oregon lawmakers are poised to make history Monday by electing the first ever openly lesbian Speaker of the House. Not just in Oregon, but in the country. Portland Democrat Tina Kotek will lead the chamber as lawmakers tackle the state budget, pension reform, and other issues. One issue not on her agenda: Same-sex marriage.

                            Kotek won't be the first openly gay person to lead a legislative chamber in the U.S. There have been at least four others. But she'll be the first woman. She calls that “humbling.”

                            Tina Kotek: "I think whenever you have a first for any community it's important."

                            But she's quick to add that being a lesbian is only part of her identity. She enters her fourth term in the Oregon House known as an advocate for health care and poverty issues. She says she understands the excitement in the gay and lesbian community over her impending Speakership. On the other hand:

                            Tina Kotek: "It's less of a big deal than it might have been ten years ago to have an out speaker. That's who we are as Oregonians. We respect diversity. I'm excited to be that first. But it's just one part of who I am and I think there are a lot of issues to take on beside LGBT issues."

                            But Kotek might not actually have to take the lead on gay and lesbian issues, says Denis Dison of the Washington D.C. based Gay and Lesbian Leadership Fund.

                            Denis Dison: "There are some very powerful legislative leaders who when they are openly gay or lesbian don't have to do much advocating."

                            He says that's because the issues important to people in power tend to become important to people further down the ranks. But long-time Washington state lawmaker Ed Murray isn't so sure. The openly gay Democratic caucus leader recently led the fight to approve same-sex marriage in Olympia. Washington voters ultimately approved it last fall. Murray says as the only openly gay person in the Oregon legislature, Kotek shouldn't wait for others to take up causes near and dear to her.

                            Ed Murray: "I think if you are the gay or lesbian or bisexual or transgender legislator, that you are and you should be the lead on the issue."

                              Can somebody tell me how such a rabidly socialist state has somehow managed to avoid instituting a sales tax? I would think all those dirty damned Dems would have put in a huge sales tax a long time ago.

                              Hmmm, I'll bet they make up for it with a "value added tax" or a "luxury tax" or some such.
