PHILADELPHIA -- Police said they arrested Andre Mitchell, 37, last Saturday night for drunken driving.
Investigators told NBC 10 Investigator Harry Hairston that they arrested Mitchell a block from his home in Northeast Philadelphia after he was involved in a car crash.
But police said just hours after Mitchell was arrested and brought to police headquarters, he broke the law again, this time from inside his jail cell.
Police said Mitchell sexually assaulted and sodomized another male inmate.
Investigators told NBC 10 News the 46-year-old victim was also locked up on drunken driving charges.
Police said the victim had fallen asleep from drinking too much and that's when Mitchell allegedly made his move.
Police sources told NBC 10 that an inmate in another cell witnessed the assault and called the guards.
Those same sources also said the guards had to literally pull Mitchell off of his victim.
"I hear things like this. I'm shocked, but then I shouldn't be because it happens a lot," attorney David Love said.

Mitchell's neighbors wouldn't speak to NBC 10 on camera, but described him as a family man, married, with an 18-month-old daughter and a 13-year-old son.
"He seems like a nice guy," the neighbor said. "That's surprising and alarming."
