Do no speak evil against one another, refers to who James is addressing the letter to. That community of Christians, amongst one another. Not those outside. And it is speaking only about personal opinions.When we criticize others, we are placing ourselves in the position as judge and pronouncing judgment upon them when we may not know or understand all the details of why someone is doing what they are doing. Again, let me remind everyone that these passages are addressing non-moral issues. When it comes to sin, false teaching or ministries, the Bible clearly teaches that we are to be discerning which means we need to make an judgment based upon God's Word.

Why are we so harsh?
Because the truth is harsh. We use great plainness of speech, and will not beat around the bush when it comes to someone's eternal soul. Watch out for those people who tell you that it's okay to believe whatever you want - they'll take you to hell with them.
It has been said "honey draws more flies than does vinegar." This really isn't a Biblical concept. The Bible teaches the exact opposite. For example, Jude says "Keep yourselves in the love of God, looking for the mercy of our Lord Jesus Christ unto eternal life. And of some have compassion, making a difference, And others save with fear, pulling them out of the fire, hating even the garment spotted by the flesh." Furthermore, you should carefully examine all of the preachers (including Jesus) in the Bible. On some, they had compassion. On others, they preached fear. It is our duty to make a difference.
The Bible sets up a standard. It tells us what is right and what is wrong. COM is merely letting this person know what the Bible warns will be the consequences for his actions. The Bible also says:
I Cor 6:2-3 Do ye not know that the saints shall judge the world? and if the world shall be judged by you, are ye unworthy to judge the smallest matters? Know ye not that we shall judge angels? how much more things that pertain to this life?

How can The Old Man judge one another's fate? It is not for anyone, besides God to decide. How can he say that this one person will die and go to Hell? How in the wide world does he know?
