    I always knew that you couldn't trust Romanists to be True Conservatives™, even though they hate so many of the same people whom God hates. Justice Antonin Scalia has long been honored as a champion of the judicial philosophy of original intent, as against legislating from the bench to create new "rights" like equal protection of the laws. Now, he hems and haws on the subject, since it might give a result that is politically incorrect under Obamunism.

    From 19th-Century View, Desegregation Is a Test

    If there is a topic Justice Antonin Scalia does not relish discussing, it is how he would have voted in Brown v. Board of Education had he been on the Supreme Court when it was decided in 1954.

    The Brown decision, which said the 14th Amendment prohibited segregation in public schools, is hard to square with Justice Scalia’s commitment to originalism, the theory of constitutional interpretation that says judges must apply the original understanding of the constitutional text.

    Brown presents originalists with a problem. The weight of the historical evidence is that the people who drafted, proposed and ratified the 14th Amendment from 1866 to 1868 did not believe themselves to be doing away with segregated schools.

    Yet Brown is widely thought to be a moral triumph. A theory of constitutional interpretation that cannot account for Brown is suspect if not discredited.

    Originalists hate the subject. Justice Scalia has called it “waving the bloody shirt of Brown.”

    “Where would you be with school desegregation?” [America-hating LIE-beral Justice Breyer] asked with a satisfied expression. “It’s certainly clear that at the time they passed the 14th Amendment, which says people should be treated equally, there was school segregation and they didn’t think they were ending it.”

    But Justice Scalia did not give a direct answer to how he would have voted in Brown.

    “As for Brown v. Board of Education, I think I would have” — and then he changed directions. He said he would have voted with the dissent in Plessy v. Ferguson, the case Brown overruled.

    In a 2005 profile in The New Yorker, Justice Scalia told Margaret Talbot that he would have voted with the majority in Brown. But he did not explain why, and Ms. Talbot wrote that “it’s hard to see an originalist justification for it.”
    Indeed it is. Scalia has revealed his true colors as a judicial activist who thinks that nine black-robed dictators at One First Street, N.E., should undo the people's democratic right to run our schools as we see fit.

    There has not been a totally reliable Supreme Court Justice since Jimmy McReynolds or Willis Van Devanter. The best ever was probably Robert Taney.

    Did you know they've allowed joos in the Supreme Court since 1916? Disgusting. That was the moment when America began its downhill toboggan ride toward Satanism, Obamaunism, and eternal hellfire.

      Unless I am mistaken, the original intent of America's Christian founders was that white landowning men would be the voting body which guided the country under Jesus. I think no Justice has done justice by the Founder's intent for many years indeed.

      Nations evolve. But with the anti-Christian abolition of slavery the orphaned poor, unable to find refuge as plantation workers or indentured servants to righteous Christians, began to drag our once-great nation into the saw-grass swamps of socialist policy.

      The evolution of America has been a devolution.

      We all know that the Supreme Court is a misnomer: the Supreme Court is held at the foot of God's great throne!. There is no justice but Jesus, and as the Chosen People of Jesus -- the persecuted, the humble, the great in spirit! -- we must stand against the revisionists, the relativists, and the egalitarianists who would turn America into a "melting pot" of mongrel ideas and perverse policies.

      Brethren and sistern, that "melting pot" stinks of BRIMSTONE! And Justice Scalia joins the rest in stirring the pot.

          It is known amongst the poor and ignorant as “Justice” but there is only one “Justice” and that is in the Hands of The Lord of Hosts

          Psalms:89:14: Justice and judgment are the habitation of thy throne: mercy and truth shall go before thy face.

          The problem is the “Creep” effect. An Amendment is decided upon and that is perhaps as it should be. But then generation after generation of judges, not mindful of God, ‘interpret’ the Amendment to suit the times. Yet the Lord’s Word is unalterable and timeless, as should be the purpose and meaning of an amendment.

          Eventually, the Amendment has lost all its original intent and is no more than a vehicle to drive a Chariot of Iron through the Lord’s Given Commandment.

          Another thing: There have been votes, and amendments, etc to address what was perceived as social ills, yet were really the bleating of Lieberals! They eventually got their way, now that we see that it simply is not working, should there not be another vote?

          Should we not demand a vote to overturn the abolition of slavery, to deprive women of the vote, reintroduce the Comstock Act, to reinstate the death penalty for a whole raft of crimes, etc?

            No, you are quite right: I refer to a Biblical evolution. The Chosen People came out of the wilderness and conquered Canaan, and the subsequent society "evolved" under God into a great nation. But as Brother Bathfire writes, America has been changed not by the fiery hand of God but by the muddy mitts of liberals, agnostics, Jews, and worse.

            Satan is at work. Look at Martin Luther King, a classic case of demonic possession. Whether Antonin Scalia is unwittingly acting as Satan's pawn (as do so many Catholics) or whether he is directly possessed by the Devil remains, to my mind, an open question.

              Probably Scalia has to check with the Vatican to see what his position would have been.
