    A disabled, violent student in North Carolina broke her teacher's
    arm in a classroom fray. A disabled Oklahoma student stabbed her
    teacher with a nail she had secreted into class. What followed?
    Summary expulsion, or at least placement in more restrictive
    classrooms?

    No. Under the 1975 Individuals With Disabilities Act, or IDEA, which
    provides the special programs designed to educate and create
    opportunities for disabled students, the teachers and school
    officials in the two states may deal with such violent and
    disruptive students with only mild punishments.

    The Oklahoma student received a three-day suspension, for example,
    and the North Carolina girl was suspended from school for two days,
    even though similar acts by nondisabled students would have resulted
    in much harsher measures.

    Such incidents, now commonplace, have led the two major teachers'
    unions -- the American Federation of Teachers and the National
    Education Association -- along with several professional
    organizations, such as the National Association of Elementary School
    Principals, to demand a major overhaul of the IDEA. They believe its
    provisions have been responsible for allowing the situation to get
    completely out of hand and they are glad it is before Congress for
    reevaluation.

    Violent and disruptive behavior by disabled students has ranged from
    defecating in the classroom to the regular battering of teachers and
    even the murder of other students.

    Says Michael Resnick, spokesman for the National School Boards
    Association, "What we are asking is that disabled students be
    treated the same way as nondisabled students -- that all students be
    viewed as equal." Resnick and other professionals want to see the
    IDEA revamped to protect teachers and students from violence in the
    classroom -- allowing school authorities to remove disruptive
    students and, preferably, transfer them to settings in which their
    special needs can be met. "Nondisabled students have rights too,"
    says Resnick.

    Pitted against these educators are parents of disabled students and
    leaders of organizations that represent the disabled, such as the
    Berkeley-based Disability Rights Education and Defense Fund. These
    groups regard any changes in the IDEA as a slippery slope down which
    hard-won rights for the disabled will slide into Dickensian misery.

    What special-education advocates want is a school system "where no
    child is deprived of education and there is no one who is expelled,"
    says Myrna Mandlawitz, a specialist in government affairs for the
    national Association of State Directors of Special Education, based
    in Alexandria, Va. Mandlawitz argues that a strong federal presence
    in special education -- and a strong IDEA -- is needed because the
    states have "a bad record," particularly before the 1975 passage of
    this law.

    At issue is a practice called "inclusion," initiated about 15 years
    ago and now widespread, in which disabled students are taken from
    special-education centers and other specialized schools and grouped
    in regular classrooms with the nondisabled. The theory behind
    inclusion is that the disabled will benefit from association with
    other students and will not tend to regard themselves as
    irredeemably different.

    According to Department of Education figures, 4.8 million school-age
    children are defined as disabled, the vast majority (3.5 million) of
    whom fall into such broad categories as the learning disabled and
    those with speech and language impairments -- groupings that include
    dyslexics and the hyperactive. About 550,000 are mentally retarded,
    while deaf and blind students number just under 100,000.

    Inclusion means mainstreaming such disabled students as dyslexics --
    many of whom can profit from contact with nondyslexics and only some
    of whom need highly individualized education, according to Steve
    Laubacher, executive director of the Orton Dyslexia Society, based
    in Baltimore.

    But also mainstreamed are the disabled children with Down syndrome
    and the autistic, who require a great deal of personal attention,
    who sometimes are not toilet trained (requiring schools to provide
    special diapering rooms) and who can be violent.

    Under an IDEA "stay-put provision," teachers and school officials
    can suspend disabled students from any category for only 10 days
    without then going to court to obtain permission from a judge to
    continue the suspension.

    It's at this point that school authorities feel most frustrated --
    and it is at this point that many educators who otherwise support
    special education become doubtful. Says John Brennan, a retired
    adjustment counselor in psychological services with the Boston
    public schools, "I think there is a need for the programs, but
    without the farout social theories in which the special-ed people
    begin to pursue one crazy fad after another."

    Going to court to remove a student deemed disruptive and a danger to
    him or herself and others takes time and a great deal of money.
    Judges are prone to grant suspension of violent students only in
    cases in which a life is threatened -- something teachers and school
    officials find difficult to prove.

    Moreover, the courts rarely are friendly to teachers' concerns.
    Their predominant philosophy is that a disability saps self-esteem --
    and it is this loss of confidence that leads the disabled student
    to lash out and turn to violence. It is an approach to the law that
    allows the courts to conclude that disabled students should not be
    punished in the same ways as nondisabled students, educators say.

    In addition, the schools often end up paying their opponents'
    attorneys' fees. Fee awards as high as $10,000 and $20,000 are not
    unusual, says Resnick. These funds must come out of school budgets
    (and therefore from taxpayer money) and be taken from the costs of
    other projects the schools have planned.

    The House Economic and Educational Opportunities subcommittee on
    Early Childhood, Youth and Families, chaired by conservative
    Republican Randy "Duke" Cunningham of California, held three
    hearings on the IDEA this summer but adjourned for the August break
    without producing a completed bill -- something the members had
    planned to do. The Senate Labor and Human Resources subcommittee on
    Disability Policy, chaired by Tennessee Republican Bill Frist, a
    conservative and physician, plans to have its version by the end of
    September.

    Educators such as Resnick, as well as advocates for the disabled,
    are asking the federal government to provide as much as another 40
    percent of what the states are paying for special-education
    programs. No one in Congress is even talking about spending that
    kind of money. Since the states now spend about $30 billion, that
    would mean at least $13 billion coming from federal funds. But the
    federal government supplies "only" about $3 billion a year -- a
    figure that may increase slightly, say Insight's sources in the
    House, but which certainly won't climb by much and may go down.

    The Clinton administration has checked in with a revised IDEA that
    would base federal grants to the states on the total number of
    students enrolled in school, rather than the number of special-
    education kids, as now is the case.

    The Education Department sees this bill as encouraging the states to
    start identifying disabled youngsters early on -- say, at the
    toddler stage -- when disabilities, especially many kinds of
    learning and speech problems, are best handled.

    But, more to the point, Education hopes that by basing grants on
    total numbers of students the states won't tend to "overidentify"
    children who have disabilities -- a problem many observers say adds
    significantly to the lists of students in special education and one
    that needs addressing.

    The administration bill doesn't address the clear and present danger
    of violence in the classroom, Resnick notes, and he also says that
    Congress has yet to deal with that problem.

    What the teachers' unions and education associations want is a
    system that allows disputes between teachers and the representatives
    of the disabled to be settled in hearings outside the courtroom --
    with no attorneys present, says Resnick. The courts, they say, must
    be a last resort. It's a demand that the disabled and their
    representatives fight tooth and nail. All three House hearings on
    the bill this summer were heavily attended by parents of the
    disabled, who also staged a 1,000-person demonstration on the steps
    of the Capitol in favor of keeping the restrictive provisions.

    The IDEA as it now stands also requires schools to pay for the
    hearing aids, eyeglasses and other needs of their disabled students,
    a cost educators want placed on state health agencies rather than
    the educational system, says Resnick.

    Congress may find some way to grant teachers and others in the
    classroom more protection -- at least when it comes to school
    violence. Last year a bill that allows schools to suspend for 45
    days disabled students who bring firearms to class was supported by
    the Clinton administration and passed by the House and Senate. This
    was a major alteration in the IDEA, and it comes despite protests
    from advocates for the disabled. School officials say they want the
    45-day suspension extended to disabled students who bring to school
    other weapons, such as knives, brass knuckles and martialarts gear.
    Many states, some of them fearful of a rise in the number of
    lawsuits from nondisabled students harmed in classrooms by the
    disabled, are taking matters into their own hands. Virginia
    authorities, for example, recently asked a federal court to overturn
    a July 3 ruling by Secretary of Education Richard Riley that the
    commonwealth violates the IDEA when it suspends violent students who
    threaten others in the classroom.

    Whatever happens, Boston's John Brennan may have the last word on
    the bottom-line issue at hand. "When kids are disruptive, you remove
    them," he says. "You give the other kids a break."

    I'll let you negotiate terms with whoever actually starts the forum. I haven't time. I spend most of my life ministering to poor, wayward girls at the Landover Home in Hawaii.     Pastor, in all due respect, it is almost impossible for a woman to get pregnant during her horrible monthly curse. I only find it retarded if a man wants it then.
