    Texas high court rules exorcism protected by law

    FORT WORTH, Texas - The Texas Supreme Court on Friday threw out a jury award over injuries a 17-year-old girl suffered in an exorcism conducted by members of her old church, ruling that the case unconstitutionally entangled the court in religious matters.


    In a 6-3 decision, the justices found that a lower court erred when it said the Pleasant Glade Assembly of God's First Amendment rights regarding freedom of religion did not prevent the church from being held liable for mental distress triggered by a "hyper-spiritualistic environment."

    Laura Schubert testified in 2002 that she was cut and bruised and later experienced hallucinations after the church members' actions in 1996, when she was 17. Schubert said she was pinned to the floor for hours and received carpet burns during the exorcism, the Austin American-Statesman reported. She also said the incident led her to mutilate herself and attempt suicide. She eventually sought psychiatric help.
    But the church's attorneys had told jurors that her psychological problems were caused by traumatic events she witnessed with her missionary parents in Africa. The church contended she "freaked out" about following her father's life as a missionary and was acting out to gain attention.

    The 2002 trial of the case never touched on the religious aspects, and a Tarrant County jury found the Colleyville church and its members liable for abusing and falsely imprisoning the girl. The jury awarded her $300,000, though the 2nd Court of Appeals in Fort Worth later reduced the verdict to $188,000.

    Justice David Medina wrote that finding the church liable "would have an unconstitutional 'chilling effect' by compelling the church to abandon core principles of its religious beliefs."

    But Chief Justice Wallace Jefferson, in a dissenting opinion, stated that the "sweeping immunity" is inconsistent with U.S. Supreme Court precedent and extends far beyond the Constitution's protections for religious conduct.

    "The First Amendment guards religious liberty; it does not sanction intentional abuse in religion's name," Jefferson wrote.

    After the 2002 verdict, Pleasant Glade merged with another congregation in Colleyville, a Fort Worth suburb.

    A message left for the church's attorney Friday evening was not immediately returned, and calls to two numbers listed in Schubert's name went unanswered.

      I think that's a rather disconcerting outcome. Exorcisms and demons have been used to mask child abuse in a lot of cases. Have a look at this sorry tale:

      The Metropolitan Police and child protection experts are stepping up the investigation on the extent of alleged child abuses linked to the practice of exorcism among evangelical African churches across the UK...


      I personally have never come across a proven case of demon possession, and I think they are generally used in the Bible in a symbolic sense - as a metaphor for an agent of evil. I guess a lot of you guys may disagree, but the idea that there are little red men with pitchforks running around America is a bit hard to fathom. Many Christians today are too ready to blame things on demons IMO, and should maybe look at humanity's inhumanity to mankind before starting to use demons as an excuse for inaction.

              Friend, you've got an unhealthy tendency to think. It matters not that your thoughts are erroneous, wooly and have no Biblical basis. I feel that the devil is whispering in your ear at night.

              ...and who is it who should be looking at inhumanity? I think you have paid little attention to the Way, The Truth and The Light that is preached here at Landover. Why, every loving post is for the guidance and education of the Unsaved Trash the world over - there's no "inaction" around here!

                Praise Jesus!

                I have yet to make a pilgrimage to Landover, but God has already blessed me by making me born and raised here in Texas. Most Texans are God-fearing Baptists, and even unsaved heathen Texas Methodists like George Bush make lieberal Baptists in other states look like pansies.

                    I'm sure brother Billybob was referring to George H. W. Bush. George W. Bush, the greatest President in US history with the possible exceptions of Ronald Reagan and Herbert Hoover, was a saved man. He may have gone to a Methodist church (Karl Rove made him do that to get votes, I think), but he spoke regularly with Pastor Deacon Fred, the chief pastor here at Landover Baptist Church. Where do you think he got the idea to protect our freedom here by fighting in Iraq?

                      Absolutely right, Brother WW. I'd also like to point out that during his "wild youth," GWB himself was a beneficiary of frequent exorcisms, usually after disappearing for a few weeks at a time in Boy's Town, just across the border from his home in west Texas. Eventually, he'd come back on his own after maxing out Daddy's credit cards, looking considerably worse for the wear.

                      Daddy used to get really pissed off about having to pay big bucks to get Junior's Mexican tattoos lasered off. The plastic surgeon always complained about that 666 tattoo on the forehead - he said it was very persistent, more like a birthmark than a tattoo and it kept coming back, so he'd just cover it with makeup. As for all those lumps on Junior's forehead, it seemed to be just an allergic reaction to alcohol, cocaine, and airplane glue. Or it might have been advanced syphilis, but either way they'd disappear after injecting steroids directly into the brain.

                      Anyway, my point is that GWB would never have sued because of those exorcisms. Indeed, he was downright grateful, especially for those "pray the gay away" sessions. One thing he hated was when other kids in his high school would call him a queer. He'd get so mad that he'd pay a couple of Daddy's secret service agents to beat up the bully. He swore that one day he was gonna have his own private security team to hunt down and "get even" with kids who'd made fun of him.
