Different birds have different characteristics. Penguins can't fly, so it seems to me that bats have more in common with most other birds than do penguins. So, unless you're prepared to acknowledge that penguins are not birds, you have to accept that bats ARE birds.

That's not entirely true, not all bats can fly there are a couple of species in new zealand and its' outlying islands that have lost the ability to fly yet, stil have the leathery wing membranes commonly known as mouse bats as they spend their time on the ground.

Bats are not birds, they have teeth, they do't have beaks or feathers, and also another fact not many people know is birds do not have penises whereas male bats do, another fact is bats have live young birds lay eggs and bats urinate which birds do not do their urea is realised with the faeces in the solid form of ureic acid.
